This English translation is provided for information only. In case of discrepancy, the French version prevails.
The purpose of these terms of use and terms of sale (the "Terms") is to set the legal framework under which FX SOFTS makes the site and the services available, and to define the conditions of access to and use of the services by "the User".
These Terms are available on the site under the "CGU-CGV" section.

The Subscriber may use the Service on a personal computer (PC, Mac, NetBook). The chosen device must have an up-to-date Chrome web browser.

The User agrees that their data and settings are used by FX Softs to provide the current services and their future developments
By using the Stynch browser extension, the User agrees that it automatically collects, while they browse LinkedIn, publicly visible data from the profiles they visit (posts, reactions, profile information displayed on the page). This data, limited to what is visible on screen, is sent to FX Softs servers and used exclusively to produce the analyses offered by the Service. The User is informed that this collection helps enrich the Service's collective database for the benefit of all users.
For authentication to the Service, FX Softs collects basic information from the User's LinkedIn account (e-mail address and profile picture), either through the LinkedIn OAuth protocol when logging in to the site, or through the information available to the extension during an active LinkedIn session. This data is used solely to identify the User and is not shared with third parties.
Any event due to force majeure resulting in a malfunction of the site or server, and subject to any interruption or modification for maintenance, does not engage the liability of FX Softs. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without notice.
The User may contact the site by e-mail at the publisher's e-mail address given in ARTICLE 1.

Temporary interruptions of the Service will, as far as possible, be notified via the Site at least 24 (twenty-four) hours before they occur, unless these interruptions are urgent.
Fx Softs reserves the right, without compensation, to permanently end the Service. The permanent closure of the Service will be notified via the Site at least 1 (one) month before it occurs; the Subscriber will no longer owe any payment from the date the Service ends.
Any event due to force majeure resulting in a malfunction of the site or server, and subject to any interruption or modification for maintenance, does not engage the liability of FX Softs. In such cases, the User agrees not to hold the publisher responsible for any interruption or suspension of service, even without notice.
ARTICLE 6 – No right of withdrawal – duration – renewal – termination
6.1 No right of withdrawal
In accordance with the provisions of article L. 121-21-8 of the French Consumer Code, the Subscriber expressly acknowledges and accepts
(i) that the provision of the Service begins immediately after their registration to the Service is validated, i.e. before the end of the fourteen clear days period provided for by the Consumer Code, and
(ii) consequently acknowledges and accepts that they do not benefit from the right of withdrawal applicable to online or distance selling.
Consequently, no request for withdrawal, cancellation or refund will be accepted for the subscribed period.
The Subscriber is nevertheless free to cancel their subscription under the terms set out below in these conditions.
6.2 Duration
There is no time limit on the use of acquired or free credits.
6.3 Reports
Ordering a Report means ordering an analysis service: Fx Softs collects and processes the author's posts, produces the analysis and delivers it as a digital Report personalised in the User's name, not supplied on a tangible medium. This service is performed as soon as payment is confirmed and is fully performed when the Report is made available, before the end of the fourteen-day withdrawal period.
By accepting these Terms of Use and Sale when ordering, the User expressly requests immediate performance of the service and acknowledges that they lose their right of withdrawal once the service has been fully performed, in accordance with article L. 221-28, 1° and 13°, of the French Consumer Code.
As the service has been performed and its result delivered, no request for cancellation or refund of an ordered Report will be accepted, whatever the reason, including a change of mind, an order placed by mistake or dissatisfaction with the conclusions of the analysis.
The analyses in the Report are produced automatically from the author's publicly visible posts as of the date they were collected. Their interpretation is solely at the User's discretion.
In the event of a defective Report (unreadable or corrupted file, incomplete content, generation error, author or period not matching the order), the User may report it by email to the address given in ARTICLE 2, stating their order reference and the nature of the defect. After verification, Fx Softs regenerates the Report free of charge and makes it available again in "My reports". This regeneration is the means of bringing the Report into conformity.
These provisions apply without prejudice to the legal guarantee of conformity for digital content provided for in articles L. 224-25-12 et seq. of the French Consumer Code for the benefit of consumer Users.
ARTICLE 7 – Conditions of access to the Service
The Subscriber declares that they have the capacity to accept these Terms, that is, that they are of legal age and are not subject to a legal protection measure for adults (court protection, guardianship or curatorship).
The Subscriber declares that they hold a bank card issued in France by a French banking institution.
ARTICLE 8 – Payment
Only payment by bank card is available on the Site to pay for the subscription to an offer.
The price of a Report is payable in a single payment when ordering. The Report is made available once payment is confirmed.
The subscription price is payable monthly. Payment is made in advance when subscribing to the Service, then each month or year, by automatic debit until the subscription is cancelled, whether at the Subscriber's initiative or that of Fx Softs.
To optimize transaction security, Fx Softs has chosen a recognized payment system widely used by Internet service platforms.
Unless the Subscriber provides evidence to the contrary, the computerized records kept in the computer systems of Fx Softs and its partners under reasonable security conditions will be considered as proof of the communications, orders, validations and payments made between the Subscriber and Fx Softs. This information will be authoritative unless the Subscriber provides written proof to the contrary. These elements are archived on a reliable and durable medium so as to constitute a faithful copy in accordance with article 1379 of the French Civil Code.
ARTICLE 9 – Suspension and/or early termination at the initiative of Fx Softs or the Subscriber
Without prejudice to any damages Fx Softs may claim, Fx Softs reserves the right to suspend a Subscriber's access to the Service and/or terminate automatically, without notice or compensation, their subscription to the Service if the Subscriber fails to comply with these Terms, in particular:
- total or partial non-payment by the Subscriber of the price of their subscription to the Service.
- actions contrary to the commercial interests of Fx Softs.
The Subscriber may terminate, without notice or compensation in favour of Fx Softs, their package or subscription if Fx Softs fails to meet its main obligations defined in these terms or for legitimate reasons.
ARTICLE 10 – Changes to these terms of use and terms of sale
Fx Softs reserves the right to unilaterally modify the content of these Terms at any time.
Fx Softs will inform each Subscriber by e-mail, at the address provided in the Subscriber's account, of any change to these terms of use and terms of sale at least one (1) month before they take effect.
If the Subscriber does not accept these changes, they will be free to cancel their subscription from their account on the Site as indicated in article 5.4 above, this cancellation taking effect at the next subscription due date. Failing cancellation, the new terms of use and terms of sale will apply from the next subscription due date following the entry into force of the new terms of use and terms of sale.
ARTICLE 11 – Applicable law – Claims - Disputes
French law applies to this contract. If a dispute between the parties cannot be resolved amicably, the French courts shall have sole jurisdiction.

Any claim regarding the application of these Terms must be sent to our Customer Service via the Site, in the https://stynch.fr/support section, so that it can be handled as quickly as possible.
If the claim submitted under the conditions described above fails, and in accordance with the provisions of the French Consumer Code, the Subscriber has the right to use, free of charge, the mediation service offered by Fx Softs. The proposed "consumer law" mediator is MEDICYS.
This mediation service can be reached:

In the event of a dispute, the parties will seek an amicable solution before any legal action. If these attempts fail, any dispute regarding the validity, interpretation and/or performance of these terms of use and terms of sale must be brought, even in the event of multiple defendants or third-party claims, before the courts of the Subscriber's usual place of residence.
